Terms of Service

1. Service Description

TrustGate is a compliance API infrastructure for adult content platforms, operated by Lumina Consulting LLC. The Service provides age verification, content moderation, payment processing, consent management, and jurisdiction control modules via a RESTful API.

These Terms of Service ("Terms") govern your use of the TrustGate API and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. Acceptable Use

The Service is intended for business-to-business (B2B) use only. By using the Service, you agree to the following:

• You are a business entity or sole proprietor and will comply with all applicable laws and regulations
• You will not use the Service for any illegal purpose
• You are responsible for the legal compliance of your platform and its end users
• You will keep your API keys and access credentials secure and confidential
• You will comply with all applicable content regulation laws, data protection laws, and industry regulations in every jurisdiction in which you operate

3. API Usage

3.1 Rate Limits

API requests are subject to rate limits. Specific limits are determined by your plan and documented in the API documentation. Requests exceeding rate limits may be rejected.

3.2 Uptime SLA

TrustGate is currently in early access. During the early access period, no Service Level Agreement (SLA) is in effect. Upon general availability, uptime guarantees will be defined in a separate Service Level Agreement.

3.3 API Changes

The API specification may change as we improve the Service. We will endeavor to provide reasonable advance notice of breaking changes.

4. Data Handling

TrustGate handles your data and your end users' data as follows:

• All personally identifiable information (PII) is encrypted using AES-256-GCM with per-tenant derived keys
• PostgreSQL row-level security enforces data isolation between tenants
• Audit logs are recorded as tamper-evident hash chains
• Data processing and storage are governed by our Privacy Policy

5. Intellectual Property

The TrustGate API, documentation, software, and all related intellectual property rights are owned by Lumina Consulting LLC. You are granted a non-exclusive, non-transferable, revocable license to use the API in accordance with these Terms.

You retain all intellectual property rights in your data and content.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Lumina Consulting LLC shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Loss or corruption of data
• Interruption or unavailability of the Service
• Acts or omissions of third-party service providers

Lumina Consulting LLC's total aggregate liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim.

TrustGate provides compliance infrastructure tooling and does not provide legal advice. Ultimate responsibility for regulatory compliance rests with you.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the State of California.

8. Termination

Either party may terminate these Terms with thirty (30) days' written notice. Lumina Consulting LLC may immediately suspend or terminate your access in the following circumstances:

• Material breach of these Terms
• Use of the Service for illegal activities
• Failure to pay applicable fees
• As required by applicable law

Provisions relating to data handling, limitation of liability, and governing law shall survive termination.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least thirty (30) days' notice of material changes via email to your registered address or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
